Michigan OWI License SuspensionIf you were recently charged with operating a vehicle in the state of Michigan, it is in your best interest to obtain legal representation as soon as possible. When you were stopped for OWI, the arresting officer probably asked you to take a breath test in order to determine your blood alcohol content level (BAC). If you failed the test—meaning your BAC was above the legal limit of .08%—or refused to take the test, your driver’s license will automatically be suspended unless you request an Implied Consent hearing. Be aware that you have only 14 days from the time of your arrest to request this hearing.

During an Implied Consent hearing, a judge reviews the details of your case to determine whether you are guilty of violating the state’s Implied Consent law. Four factors must be considered in order for the judge to uphold your charge. First, did the officer who stopped you have cause to believe you were driving under the influence of alcohol or drugs? Next, did the officer place you under lawful arrest for OWI? Thirdly, did you reasonably refuse to take a breath, blood, or urine test? And finally, were you informed of the consequences of refusing to take the test?

If the answer to either of the above questions is no, then you cannot be convicted of breaking the Implied Consent law, and as a result, your driving privileges will be restored. If the judge determines all four requirements were met, your driver’s license will be suspended immediately. It is important to know, however, that you will still face criminal OWI charges regardless of the outcome of your Implied Consent hearing.
