You have the fact that the law is much less tolerant in the area of drunk driving today than even five years ago or ten years ago.  How are juries in this area? 

Juries are very tough and the reason is because all of us are on an almost daily basis deluged with anti-drug driving information from the media.  A lot of it is presented through or by Mothers Against Drunk Driving (MADD) but the general press is very fascinated with this area of law as well.  In fact we’ve just heard  yesterday that the United States Supreme Court Justice Scalia’s daughter was arrested for drunk driving.  That's been all over the news.  You hear frequently and regularly about people who are harmed, injured or killed by drunk drivers. 

 The public comes in and the typical juror comes into the courtroom predisposed to convict on a drunk driving case.  Which means it's our job as a defense attorney to really educate them and make them understand that things are not as black and white as they think they are and that there are other issues that they need to consider in protecting one of their fellow citizen’s constitutional rights.  That’s what a jury trial is all about.
